Butterbaugh vs. Department of Justice

Effective December 21, 2000, Title 5 United States Code 6323(a) was amended so that employees were no longer required to take military leave on nonworkdays during a period of military duty. Employees who previously exhausted their military leave and were required to use annual leave for nonworkdays while on a period of military duty may be entitled to make administrative claims for restoration of some amount of annual leave. Departmental guidance was issued to all employees on this decision.
